Protus IP Solutions

According to statistics provided by our members, Protus is now the largest sender of junk faxes into the USA.  They are located in Canada, but thanks to the amendment to the TCPA in the CAN-SPAM law, the TCPA was clarified to include out of country broadcasters as well:

47 U.S.C. § 227(b)(1)(C) [italic text added in the CAN SPAM Act of 2003]
It shall be unlawful for any person within the United States or any person outside the United States if the recipient is within the United States to use any telephone facsimile machine, computer, or other device to send an unsolicited advertisement to a telephone facsimile machine;

Max Margulis is suing them on my behalf. They've admitted to sending hundreds of junk faxes in that suit. 

In addition, as I predicted 8 months ago (in December 2004), they now have sought protection of the OBRPA (see Business Records Protection Act, R.S.O. 1990, c. B.19), but this act is just a smokescreen. The way the law works is that if they don't comply with US discovery, they will lose the case. So the OBRPA is their problem. In addition, US courts have not granted the OBRPA high deference due in part to its lax enforcement. There are numerous cases of this.

Finally, the OBRPA only applies to forced requests from a judicial authority, not to information supplied voluntarily by the business. So if they choose (on their own) to voluntarily supply the information to the US court, they are not in violation.

When fax.com had too much business, they used Protus to send out their excess. Protus executives knew exactly what they were doing since they traveled to California to meet with fax.com. As a result of that personal contact, most of fax.com excess traffic was sent via Protus.

If the removal number number recording sounds like this:

  • "welcome to the toll free fax number removal service. To remove your fax number, please enter your 10 digit fax number including the area code followed by the # key". (e.g., 866-892-2681, 866 390 0963)

then it's highly likely you've been hit by Protus IP Solutions. 

If you have a lot of faxes, sort them into piles based on similar header styles. Do any of your piles have faxes with the headers in the following examples:

Notes on secondary style:

  • in some cases, the Fm: might be cropped off at the left.
  • in the To: field, the "name" of the person is supposed to be outside the parens. So if the spammer configures "name" = "number" then you get the repeated effect.

In a conflict situation, where the recording and headers don't give the same answer, the headers are the more reliable to tell the source of the fax.

Here are more details on the header format which is the most reliable way to tell where your fax came from. Since 2002, Protus has used 3 different header styles. Please refer to the following reference document: ProtusHeaders.pdf and note the following:

  • Page 1 shows the main header format used by Protus since May 2004
  • Page 2 shows the main header format used by Protus prior to May 2004. This is very similar to the new format; the only difference is that the older font was more condensed.
  • Page 3 shows the alternate header format that is also used on less than 5% of the faxes from Protus. Note the font is different, the style is different (EST, Page number), and the order of the Fm: and To: fields is different, as is the case on Pg (vs. PG).

For the main header format note the following:

  • To: is almost always empty. If it isn't, it will have your phone number in this format: 12125551212
  • Fm: field is empty about half the time. If it isn't, it will have the "name" of the company or person this fax is supposedly from. It's 100% phoney. The advertiser can put anything there he wants including a number. So on about 2% of the faxes, you'll see a number, e.g., the removal number. Remember, this field is ANYTHING the advertiser wants.
  • The "Fm:" in a few cases will be entirely missing
  • The maximum size of the name in the Fm: field is 16 characters max
  • The time is always EST even though it doesn't say that.

For the alternate header format style:

  • The Fm: field is first, and can be anything up to 16 characters; it is supposed to be the advertiser name.
  • The To: field is the recipient name (phone), e.g., "Joe Schmoe (12125551212)". However, since the junk faxers don't know your name, you'll see the phone number repeated twice, e.g., To: 12125551212 (12125551212)

For serving them, if they accept service, you can do it anyway you want. But they refuse to comply with a subpoena unless you domesticate it via letters rogatory process which is complicated.

Another option for service of a complaint:

They will do the service (in my cases a subpoena), if I send $50.00 (Canadian) and complete and send a form "USM 94" (which is available on the net or at the US Marshall's office), or at http://www.hcch.net/e/conventions/text14e.html. Mail the $50.00 w/completed form and the Orig/copy and 1 xtra copy to - Minister of Finance, Ontario Court of Justice, 393 Main Street, P.O. Box 1208, Haileybury, Ontario, Canada P0J1KQ...therefore, the company or person (s) have no excuse for not responding...

They are violating Canadian law by not identifying themselves and their client on the fax (see the Junk fax Q&A question on this).

Called him 8/25 to check on the status of subpoena I sent him. He's on vacation until 9/7.

Richard Zelma reports the following (7/23/04):

I just spoke with Tom Martin at Protus. He recognized my name immediately. He said he's the CFO of the company and will not cooperate with me except through litigation. He also asked me to not call Ms. Wymore any more since they have to pay her when she discusses anything with me.

I never called her, she has called me! The times she called was when I called Protus to complain about the faxes. In her calls, she said they had my number removed from their system but they couldn't confirm when. Could have been yesterday.

1/25/05: I called Jocelyne Côté-O'Hara, Chairman of the Board, but she refused to speak to me and said I should talk to Protus's lawyers about a legal matter. I emailed Bryan Kerdman who is also on the board and he said he'd pass my email on to the board.
