Make a phone call

If you live in California, you can make a huge difference by making a single phone call. You may not think that it does make a difference, but because so few people actually do it, making a single phone call is really significant.

Protecting Californians from having their home and office fax machines hijacked by junk fax advertisers is the goal of AB 2944 by Assemblywoman Christine Kehoe (D-San Diego), Kevin Shelley, and Senator Debra Bowen (D-Redondo Beach). Call each of these phone numbers listed below and say the following:

"Hello, this is <your name> from <your city>. I'm calling to urge the Assemblymember to vote to support AB 2944....."

It's easy and quick. And it does make a difference.

Background on the legislation

SB 1358 (Bowen) would bring California into compliance with federal law. 

AB 2820 (Cardenas, Correa, Wyman, Wiggins) and AB 2568 (J. Campbell) seek to take away your rights and make it easier to junk fax you. That is why they are opposed by the California Attorney General.

SB 1358 Analysis
This bill brings California into full compliance with the TCPA and eliminates any potential ambiguity to sue. It is supported by the California Attorney General among many others and opposed by fax.com.

AB 2820 Analysis
AB 2820 proposes an opt-out scheme that would be in direct conflict with the federal ban on junk faxes. This bill is supported by fax.com and opposed by the AG. Need we say more? It would create a conflict between California law and the TCPA since it would allow faxes until you put yourself on a Do Not FAX list. It only applies to residential customers. See also this letter opposed to 2820. The first AB 2820 Analysis has a list of supporters. Notice that the list of supporters is basically fax.com and fax.com clients. And that the list in opposition is only the California Attorney General despite the fact that everyone hates junk faxes. This is because few people knew about the bill since there is no existing group that would logically organize any opposition. The Congress of California Seniors is listed, but when they found out what this bill was really about, they removed their name. This bill passed the Assembly 51-17 on May 29, 2002. The Assembly floor analysis indicated opposition by the Attorney General and the fact it would create confusion. But few people read that part and just looked at the list of Assembly members supporting the bill. Those people thought they were making the law tougher, not easier. AB 2568 Analysis
This bill conflicts with the TCPA since it would allow junk faxing with an established business relationship. It is totally unnecessary. Bowen's bill is much better to accomplish compliance with the TCPA.
